TERMS AND CONDITIONS OF SALE

General Information

 Kuickly Go, LLC (en adelante, «la Empresa») es una sociedad de responsabilidad limitada constituida y registrada en el Estado de Nuevo México, Estados Unidos de América. La Empresa opera como distribuidor especializado de productos de ballet para el mercado estadounidense, encargándose de su promoción, venta y distribución a tiendas, estudios de danza y minoristas.

The Company markets its products through participation in industry trade shows and exhibitions, as well as through direct sales to stores, dance studios, academies, and retailers throughout the United States.

These Terms and Conditions of Sale (hereinafter, the «Terms») govern all commercial transactions between the Company and its customers. By placing an order, the customer acknowledges having read, understood, and fully accepted these Terms.

Products and Manufacturing

 The products offered by Kuickly Go, LLC are ballet articles (footwear, apparel, and accessories) manufactured on demand in the specialized production facilities of their European manufacturer. Given the customized and made-to-order nature of these products, the customer should be aware that delivery times may vary depending on material availability and the manufacturer’s production capacity.

Kuickly Go, LLC sells products directly to its customers. All costs arising from international shipping, customs duties, and other import fees are fully borne by the Company. The customer shall only be responsible for local tax obligations that may arise in their jurisdiction (for example, applicable state or local sales taxes in accordance with the regulations in effect in each state).

Prices and Payment Terms

 Product prices are expressed in United States dollars (USD) and do not include state or local sales taxes, which shall be calculated and included in the invoice as required by applicable law.

The Company reserves the right to modify product prices at any time without prior notice. However, the prices applicable to an order shall be those in effect at the time of order confirmation.

Pedido mínimo: Todos los pedidos están sujetos a un importe mínimo de 500 USD, sin incluir impuestos ni gastos de envío.

El pago se realizará conforme a las condiciones acordadas en la oferta o factura correspondiente. Con carácter general, se requiere un anticipo del 50% para confirmar el pedido e iniciar la producción, y el 50% restante antes de la expedición de la mercancía.

Loyalty Discount Program

Discount Levels by Purchase Volume

Kuickly Go, LLC offers a progressive discount program based on each customer’s annual accumulated purchase volume. The discount levels are as follows: 

Program Mechanics

 Recalculation with each order: With each new order, the customer’s accumulated purchase volume for the current year is recalculated. If the accumulated amount reaches a new discount level, that discount shall be applied immediately to the current order and all subsequent orders.

Year-over-year transition: At the beginning of each new calendar year (January 1), the customer shall start with the discount level corresponding to the accumulated purchase volume of the previous year. This discount shall be maintained as a guaranteed minimum until the current year’s accumulated purchases reach a higher level, with the most favorable discount between the one earned from the previous year’s purchases and the one generated by the current year’s purchases always being applied.

Example: If a customer accumulated $6,000 in purchases during 2026 (7.5% level), they will start 2027 with a 7.5% discount. If during 2027 their accumulated purchases only reach $2,000 (2.5% level), they will maintain the 7.5% inherited from the previous year. If at any point during 2027 their accumulated purchases exceed $10,000, they will automatically move to 10%. At the end of 2027, if their total purchases were $3,200 (5% level), they will start 2028 with the 5% corresponding to their 2027 purchases.

Campañas promocionales y eventos comerciales

Los pedidos realizados dentro de una campaña promocional o de un evento comercial — ferias, campañas de temporada como la vuelta a la academia, u otras acciones puntuales — se rigen por las condiciones propias de esa campaña, que se comunican en cada caso.

En estos pedidos no se aplica el nivel de fidelidad acumulado por el cliente, sino las condiciones de la campaña, que pueden combinar un descuento por el volumen del propio pedido con un descuento promocional adicional, acumulables entre sí cuando así se indique. Los tramos y porcentajes son específicos de cada campaña y pueden variar de una a otra.

Estos pedidos sí computan para el volumen de compras acumulado del año y, por tanto, para el nivel del Programa de Fidelidad del ejercicio siguiente.

Descuentos fuera de campaña

Fuera de campañas y eventos, los descuentos del Programa de Fidelidad no son acumulables con otros descuentos especiales u ofertas promocionales: en caso de solape se aplicará el más favorable para el cliente, pero nunca de forma acumulada.

Discounts under this program are exclusive to the Kuickly Go, LLC Loyalty Program and may not be transferred or assigned to third parties.

Orders and Shipping

Order confirmation by the customer constitutes a binding purchase commitment, particularly given that products are manufactured on demand. Once an order is confirmed, it may not be canceled except by express written agreement of the Company.

Plazos habituales: Los artículos fabricados bajo demanda se producen generalmente en 2 o 3 semanas; los artículos disponibles en stock se preparan en 2 o 3 días laborables desde la recepción del pago. El transporte hasta Estados Unidos añade aproximadamente una semana más.

Nuevas colecciones: Cada febrero se presenta la nueva colección y las primeras entregas de esa colección se realizan en junio del mismo año. Los pedidos realizados en ferias se sirven, por tanto, a partir de junio; desde julio, la nueva colección está disponible con los plazos habituales descritos anteriormente.

Delivery times are estimates and depend on manufacturing lead times and international shipping. The Company shall make its best efforts to meet the indicated delivery times but shall not be held liable for delays caused by circumstances beyond its reasonable control, including, without limitation, customs delays, international transportation issues, or force majeure events.

Shipping costs within the United States shall be communicated to the customer in the corresponding quote and may vary depending on the destination, volume, and weight of the order.

Return Policy and Warranty

Made-to-Order Products

Since the products sold by Kuickly Go, LLC are manufactured on demand according to order specifications, returns are not accepted for change of mind, incorrect size or model selection, or for reasons unrelated to manufacturing defects.

Returns for Manufacturing Defects

Returns shall be accepted only in the following cases:

• Manufacturing defects: the product has defects attributable to the manufacturing process or the materials used.
• Product received differs from the one ordered: the product delivered does not match the specifications of the confirmed order.

Procedure: The customer must report the issue in writing within thirty (30) calendar days of product receipt, providing a detailed description of the defect and photographic evidence. The quality control department of the manufacturing brand shall evaluate the claim and issue a determination. The return or exchange shall only be processed once said department has validated the manufacturing defect.

Return Shipping Costs

Confirmed manufacturing defects: Return shipping costs shall be fully borne by Kuickly Go, LLC. The Company shall arrange product pickup or provide a prepaid shipping label.

Returns within the first 30 days for justified cause or as provided by law: In cases where applicable law grants the customer a right of return, or where there is a duly justified cause accepted by the Company, the customer shall bear the transportation costs to the address designated by Kuickly Go, LLC, which shall typically correspond to the facilities of the manufacturing brand’s factory of origin.

In all cases, returned products must be in their original condition and packaging, unused and unaltered.

Time Limit for Return Requests

The deadline for reporting any manufacturing defect or product issue is thirty (30) calendar days from the date of receipt. After this period, claims shall not be accepted unless applicable law provides for a longer period, in which case the legal provision shall prevail.

Product Warranty

Products distributed by Kuickly Go, LLC are covered by the manufacturer’s warranty according to the terms established by each brand. The Company shall act as an intermediary in managing warranty claims with the corresponding manufacturer.

The warranty does not cover damage resulting from normal use, wear and tear, misuse, negligence, unauthorized product modifications, or inadequate storage.

Limitation of Liability

The total liability of Kuickly Go, LLC to the customer for any claim arising from or related to the sale of products shall not exceed, under any circumstances, the total amount paid by the customer for the product(s) that are the subject of the claim.

The Company shall not be liable for indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, revenue, or data.

Intellectual Property

All trademarks, logos, images, and marketing materials used by Kuickly Go, LLC are the property of their respective owners. The customer does not acquire any intellectual property rights over the brands or products beyond the authorized right of resale.

Data Protection

Kuickly Go, LLC shall process the customer’s personal data in accordance with its Privacy Policy and applicable legislation. Data provided shall be used exclusively for the management of the commercial relationship, including order processing, related communications, and administration of the Loyalty Program.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States of America, without regard to conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of the State of New Mexico.

Amendments

Kuickly Go, LLC reserves the right to amend these Terms at any time. Amendments shall become effective upon publication on the Company’s website. Customers are encouraged to review these Terms periodically. Placing an order after an amendment constitutes acceptance of the updated Terms.
